THC Beverages Fuel Business Growth

Marz Community Brewing Co. has emerged from the pandemic downturn with a booming line of hemp-derived THC beverages. Their products, including the low-dose and high-potency seltzers 'Bong Water' and 'High Tea,' now constitute nearly half of the company's production between their McKinley Park headquarters and Logan Square location. The surge in demand led Marz to move some beer manufacturing to Louisville, Kentucky, in partnership with Against the Grain Brewery.

Illinois Hemp Ban Poses New Challenges

Businesses like Marz are grappling with Illinois’ November 12 deadline for a sweeping ban on nearly all intoxicating hemp products. Ed Marszewski, founder of Marz Brewing, said, "We're going to have to lay people off. We won't have enough income to pay them." The ban stems from a comprehensive regulatory overhaul signed by Gov. JB Pritzker in June, aligning state law with federal guidelines and imposing a stricter timeline than federal rules, which extend to December 11. Industry groups have legally challenged the ban, claiming it would devastate farmers, infusers, distributors, and retailers.

Local Breweries Struggle to Compete

Hopewell Brewing Co. partner Jonathan Fritz argues that Illinois’ earlier deadline puts local breweries at a disadvantage compared to neighboring states. Hopewell, which launched the popular THC drink Choom in 2024, is discounting remaining inventory and winding down THC beverage sales due to the new regulations. THC beverages at Hopewell accounted for nearly a third of its on-site sales. Revolution Brewing, Chicago’s largest craft brewer, already halted their Reverb THC line and advocates for legislative changes to allow THC beverages in liquor stores.

Adapting to New Regulations

Perfectly Dosed, a Humboldt Park business making THC emulsion ingredients for about 50 Illinois brands, is considering relocating warehousing and fulfillment if Illinois' tight restrictions persist. Co-founder Glenn McElfresh voiced uncertainty about future investments in the state. Perfectly Dosed intends to apply for a new manufacturing license from the Illinois Department of Agriculture, which now requires all hemp product handlers, processors, and extractors to obtain licenses. The process requires a $5,000 fee and on-site inspection.

Large dispensary operators, such as Cresco Labs and Nature’s Grace and Wellness, support the regulatory changes and anticipate some products will move into the regulated cannabis market. Under the new guidelines, hemp-derived THC products exceeding federal potency limits must be sold at state-licensed dispensaries, subject to the same taxes as cannabis—between 22% and 37% in Chicago.

Retailers and Venues Adjust Inventory

Retailers like South Loop Market’s Logan Square location benefited from THC beverage sales, which replaced declining beer sales and made up about 20% of wine and spirits department revenue. Owner Anas Masoud is stocking up ahead of the ban but is concerned for small business survival. Major venues and distributors, including Green Thumb Industries, are removing hemp-derived THC drinks to comply with the new law, affecting events and locations such as the United Center, Salt Shed, and Navy Pier.

Looking Ahead: Market and Legislative Uncertainty

The hemp-based THC beverage market is projected to reach $4.1 billion by 2028, according to Euromonitor International. Industry leaders hope for future legislative revisions to create a stable, regulated pathway for THC beverages in Illinois. Until then, the looming hemp ban leaves Chicago businesses navigating a rapidly shifting landscape, with job losses, supply chain changes, and uncertain prospects.
